Terms And Conditions

Please read these Terms & Conditions carefully before placing any orders on https://loveofyourlocal.com.au (Site).

For the Love of your Local is a CUB campaign designed to support Australian pubs.

Subject to these Terms & Conditions, CUB Pty Ltd trading as Carlton & United Breweries, ABN 76 004 056 106 (CUB, we, us) is providing the For the Love of Your Local online platform for the purpose of facilitating the purchase of beer vouchers, and any related services, through the Site.

CUB will provide the For the Love of Your Local platform until 6 October 2020, or until we reach $2M worth of donations.

CUB’s service

1  CUB provides a platform which enables you to purchase vouchers from CUB in respect of participating venues (Venue) for the redemption of the specified beer at the Venue (Vouchers).

2  For each beer you purchase, CUB will donate the equivalent volume of that product to the Venue when it re-opens, rounded up to the nearest whole keg and capped at 20 kegs per Venue.

Delivery of Vouchers

3  Vouchers are purchased online via the Site. The purchase of any Voucher is deemed to be complete at the time you receive a Voucher confirmation to your nominated email address.

4  Vouchers are valid for redemption only:

  1. at the Venue specified on the Voucher; and
  2. for the product entitlement specified in the Voucher.

Voucher terms & conditions

5  To redeem your Voucher, present it at the Venue prior to the expiry of the Voucher.

6  Vouchers cannot be exchanged or redeemed for cash or any other legal tender.

7  CUB will not replace lost or stolen Vouchers.

8  Vouchers can only be redeemed at the Venue stated on your Voucher and are not transferrable to any other participating venue.

9  In accordance with liquor licensing requirements, you may redeem no more than 4 pints per sitting if you are ordering alone and no more than 4 pints per person per sitting if you are ordering on behalf of a group.

10  Once the Voucher has been purchased you cannot add any additional Products to that Voucher. If you wish to add any additional beer entitlements, you may purchase a new Voucher provided it does not exceed the maximum allowed amount set out in clause 25 below.

Voucher validity

11  You can redeem your Voucher at any time your nominated Venue is open during the validity period.

12  Vouchers remain valid until they expire.

13  Your Voucher will expire 3 years from date of purchase, unless it expires earlier under clause 16 below.

14  You agree and acknowledge that:

  1. expired Vouchers do not retain any value;
  2. if your Voucher expires, you will lose any and all entitlements specified in your Voucher; and
  3. CUB makes no guarantee that your preferred venue is participating in this campaign.

15  You agree and acknowledge that at the date of Voucher purchase, Venues are not permitted to open for dine-in trade due to the human coronavirus disease that has been named ‘COVID-19’ by the World Health Organization.

16  You agree and acknowledge that if, for any reason including but not limited to the impact of ‘COVID-19’, the Venue for which you have purchased a Voucher does not resume trading, your Voucher will automatically expire and you will forfeit any entitlement to the Voucher and the product specified in the Voucher.

Eligibility to purchase

17  The purchase of Vouchers on the Site is open only to Australian residents who are aged 18 or over (Eligible Purchaser). If it becomes apparent that you are not an Eligible Purchaser, CUB reserves the right to prevent you from ordering a Voucher, or to cancel your Voucher, and the Venue reserves the right to prevent you from redeeming the Voucher in accordance with responsible service of alcohol regulations.

Payment

18  Unless otherwise agreed, the price you must pay for any Voucher will be the price for the Voucher as displayed on the Site.

19  Prices shown on the Site are in Australian dollars and are inclusive of GST. Prices are subject to change effective immediately upon posting to the website or other form of notification.

20  Payment must be made via PayPal Australia and must be made at the time you order your Voucher, or the order will not be processed. You confirm that the PayPal Australia account that is being used is yours or that you have been specifically authorised by the owner of the PayPal Australia account to use it. If PayPal Australia refuses to authorise payment to CUB, CUB will not be liable for any delay or non-delivery.

21  CUB will then forward the proceeds to the relevant Venue’s designated PayPal account (less applicable GST).

No on-sale

22  CUB sells the Vouchers to you for personal use at the Venue nominated on the Voucher.

23  You must not re-sell the Vouchers.

24  If CUB become aware that you intend to purchase the Vouchers on the Site for re-sale, CUB reserves the right to prevent you from ordering Vouchers, or cancel your order as applicable.

Minimum & maximum orders

25  The minimum order for the Vouchers on the Site is as set out in the ‘price’ column in the table below and varies according to the region in which the Venue is located.

You may place multiple orders but the cumulative value of all orders must not exceed $500 in VIC, NSW, TAS, ACT, SA and WA. Cumulative value of all orders in QLD must not exceed $100.

26  Purchases can only be made in increments of $10 or $12 as per the table above. For example, if the Venue is located in Metro Melbourne region, the product the subject of the Voucher shall be a Carlton Draught pint, and the Voucher can only be loaded in increments of $12 subject to the cap set out in clause 25 above.

Returns & refunds

27  CUB will not provide you with a return or refund for change of mind. If you are experiencing an error with your Voucher, please Contact Us.

Privacy

28  CUB handles personal information in accordance with its Privacy Policy.

29  We may send you information, advertising, promotional or other marketing material from time to time. This material may be in relation to the Vouchers you have ordered, or other products or information that we may consider to be relevant, useful or otherwise informative to you. To unsubscribe from receiving this information, please Contact Us.

Your details

30  In order to make purchases on the Site you will be required to provide your details and confirm that you meet the Eligible Purchaser requirements. In particular, you must provide your real name, date of birth, phone number, e-mail address and other requested information as indicated. You are required to provide information that is true, accurate, current, and complete in all respects. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information you provide. It is a condition of purchase, and legal requirement, that you verify that you are 18 years of age or over. If you do not confirm that you are 18 years or over, your Voucher will not be processed. If we become aware that you have purchased, or you intend to purchase, a Voucher and you are not 18 years or over, we reserve the right to prevent you from ordering, or cancel your order as applicable. Venues may refuse to redeem your Voucher in accordance with responsible service of alcohol regulations, including if they become aware you are not 18 years or over or are intoxicated at the time of redemption.

Indemnity

31  You hereby indemnify CUB, and keep CUB indemnified against all actions, claims, proceedings or demands which may be brought against CUB, arising out of any breach of these Terms & Conditions by you.

32  Furthermore, if you breach these Terms & Conditions, in addition to any other rights we may have, any pending Voucher orders will be cancelled and not delivered.

Site Use Disclaimer

33  The Site is provided by us in good faith but we do not make any representations or warranties of any kind, express or implied, in relation to all or any part of the Site or the Site’s contents, and all warranties and representations are hereby excluded to the extent permitted by law. The contents of the Site do not constitute advice and should not be relied upon in making, or refraining from making, any decision. To the extent permitted by law, we hereby disclaim all liability (howsoever arising) in connection with any loss and/or damage, arising out of or in connection with any use of, or inability to use, all or any part of the Site’s content, the Site and/or any website to which the Site is linked, or any action taken (or refrained from being taken) as a result of using any of these.

Legal Notice

34  CUB support the responsible service of alcohol. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.

Miscellaneous

35  These Terms & Conditions are governed by the laws in force in Victoria, and you and CUB submit to the non-exclusive jurisdiction of the courts of Victoria.

36  If any provision of these terms is void, unenforceable or illegal and would not be so if words were omitted, then those words are to be severed and if this cannot be done, the entire provision is to be severed from these terms without affecting the validity or enforceability of the remaining provisions.

37  A failures to exercise or delay in exercising any rights under these terms does not constitute a waiver and any right may be exercised in the future. Waiver of any of these terms must be in writing and is only effective to the extent set out in that written waiver.
